By accessing or using Hope RCM ("the Service"), operated by Hope Consultation ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
Hope RCM is a cloud-based revenue cycle management (RCM) platform designed for medical laboratories and clinics. The Service includes claim management, billing automation, analytics, HIPAA compliance tools, and related features as described on our pricing page.
The Service is designed to assist covered entities and business associates in meeting their obligations under the Health Insurance Portability and Accountability Act (HIPAA). By using the Service, you agree to execute a Business Associate Agreement (BAA) with Hope Consultation. You remain solely responsible for your own HIPAA compliance obligations.
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
Paid subscriptions are billed in advance on a monthly or annual basis. All fees are non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension or termination of your account.
You agree not to: (a) use the Service for any unlawful purpose; (b) submit false or fraudulent claims; (c) attempt to gain unauthorized access to any part of the Service; (d) reverse engineer or attempt to extract source code; (e) use the Service to store or transmit malicious code; or (f) interfere with the integrity or performance of the Service.
You retain ownership of all data you submit to the Service. By using the Service, you grant Hope Consultation a limited license to process your data solely to provide the Service. We will not sell your data to third parties.
The Service, including its software, design, and content, is owned by Hope Consultation and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES. USE OF THE SERVICE IS AT YOUR OWN RISK.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HOPE CONSULTATION SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU IN THE TWELVE MONTHS PRECEDING THE CLAIM.
Either party may terminate the agreement at any time. Upon termination, your access to the Service will cease. You may export your data within 30 days of termination. We reserve the right to terminate accounts that violate these Terms.
These Terms shall be governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules.
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the updated Terms.
